| Details | Der Vortrag hinterfragt die politische Funktion des im Vordringen begriffenen verfassungsrechtlichen "Neutralitätsprinzips" in der Demokratie. Ausgangspunkt ist die nur scheinbar plausible Vorstellung, Wahrheit, Vernunft und demokratische Mäßigung lägen „in der Mitte“. Diese Logik der Mitte trägt aber die aggressive Form von Neutralität als rechtlichem Prinzip nur scheinbar: Neutralität ist, als Rechtsprinzip, weniger der Schutz fairer Wettbewerbsbedingungen als vielmehr zunehmend eine autoritäre Kommunikationsregel, die politische Rede diszipliniert, anders gesagt: die verrechtlichte Form eines "Extremismus der Mitte", der sich als administrative Sachlichkeit, Expertise, gerichtliche Kontrolle oder institutionelle Moderation verkleidet, aber auf die Neutralisierung von Widerspruch abzielt. English Version: Authoritarian legalism and the “neutrality” principle: Speech regimes and rules of bullshit The talk will examine the political function of the constitutional ‘principle of neutrality’, gaining more and more ground in (German) constitutional law. What may seem like a common sense principle of centrism and moderation, in fact only superficially hides the aggressive nature of neutrality as a constitutional principle: As such, neutrality is less about safeguarding fair conditions of competition. Rather, it functions as an authoritarian speech rule that disciplines political discourse; in other words, it is the legalized form of an “extremism of the center” that disguises itself as administrative objectivity, expertise, judicial oversight or institutional moderation, but aims to neutralize dissent. |
